Terms and Conditions

These Terms and Conditions ("Terms") govern your use of Votero, powered by Royal Bengal AI ("Votero", "we", "us"), available at votero.royalbengal.ai. By creating an account or using the service you agree to these Terms. If you do not agree, do not use the service.

What Votero provides

Votero is a platform for running digital elections. We provide the tools. The organisations and people who run elections, called commissioners, are responsible for their own elections, including who they invite, what they put to a vote, and how they conduct it. We are not a party to any election and we do not control its outcome.

Accounts and roles

To use Votero you provide accurate information and keep your sign-in details secure. A commissioner runs elections for an organisation. A committee member reviews elections before they proceed. A voter casts ballots. Every commissioner and committee member is also a voter and can vote only in elections where they have been added to the voter list. You are responsible for activity under your account.

Acceptable use

You agree not to misuse the service. This includes not attempting to vote more than once, not impersonating another person, not tampering with or attempting to break the voting, payment, or verification systems, not uploading data you have no right to use, and not using Votero for any unlawful purpose. We may suspend access that violates these Terms.

Pricing, payment, and refunds

Votero is priced per election, billed by the number of voters in the categories an election covers, with an optional charge for face verification when a commissioner turns it on. There is no subscription. Payment is taken through Stripe before an election goes ahead. Prices are shown before you pay. A refund returns the election to a draft state and is processed back through Stripe; refunds are confirmed by a one-time code sent to the administrator email. Taxes, if any, are your responsibility.

Committee approval

Where an organisation has committee members, an election must be approved by every committee member before it can be paid for and launched. A rejection by any committee member blocks payment until it is resolved. This control is set by the organisation, not by us.

Voting and eligibility

Only voters added to an election's voter list may vote in it, and only while the election is open. Ballots are recorded without a link to the voter, so votes are anonymous. After a vote is recorded, the voter receives a confirmation email that does not reveal the choice. We do not guarantee any particular turnout or result.

Face verification

For elections where a commissioner turns on face verification, you complete a face and liveness check, run by our provider Didit, before you vote, and you agree to that check when you begin it. The check confirms a live, present person and that the face is yours, and it is used to keep one person to one vote across accounts. Votero does not store your face image. A check is required close to the moment you vote. If a check cannot confirm you, or your face is found to belong to another voter account, you may be unable to vote from that account, and you should contact the organiser.

Semi-auto location checks

For elections set to semi-auto, a voter must be inside a voting area defined by the commissioner to cast a ballot, and the voter's device must share its location for that check. This location check is a deterrent against voting from outside the area. It depends on the accuracy of the device and the browser, can be refused by the voter, and can be circumvented by a determined user. It is not a guarantee of physical presence, and we are not liable for the accuracy or reliability of device location.

Service availability

We work to keep Votero available and accurate, but we provide it on an "as is" and "as available" basis. We do not warrant that the service will be uninterrupted, error free, or fit for a particular purpose, to the fullest extent allowed by law.

Limitation of liability

To the fullest extent permitted by law, Votero and Royal Bengal AI are not liable for indirect, incidental, or consequential damages, or for loss of data, profit, or goodwill, arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us for the election to which the claim relates.

Your responsibility for elections

If you run an election, you are responsible for its legality and conduct, for the accuracy of the roll you upload, for having the right to contact the people you invite, and for any dispute arising from the election. You agree to indemnify us against claims arising from your use of the service or your conduct of an election.

Intellectual property

The Votero platform, its software, and its branding belong to Royal Bengal AI. These Terms do not give you any right to copy, resell, or reuse the platform beyond using the service as intended.

Governing law

These Terms are governed by the laws of the State of [STATE], United States, without regard to conflict of law rules. You agree that disputes will be resolved in the courts located in that state. [This bracketed item must be set to the state you choose with your legal adviser.]

Changes to these Terms

We may update these Terms as the service changes. When we do, we will revise the effective date above. Continued use of Votero after a change means you accept the updated Terms.
